We have a simple approach to data protection and privacy which adheres to the 13 Australian Privacy Principals.

Our obligations under the Privacy Act 1988 (Privacy Act) & Privacy Amendment (Enhancing Privacy Protection) Act 2012:

  • This privacy policy sets out how we comply with our obligations under the Privacy Act. As an Australian based organisation, we are bound by the Australian Privacy Principles (APPs) in the Privacy Act which regulate how organisations may collect, use, disclose and store personal information, and how individuals may access and correct personal information held about them.
  • In this privacy policy, ‘personal information’ has the same meaning as defined by section 6 of the Privacy Act: Information or an opinion about an identified individual, or an individual who is reasonably identifiable:
    (a) whether the information or opinion is true or not; and
    (b) whether the information or opinion is recorded in a material form or not.

Collection

We collect your personal information so that we can provide you with the products, services or information that we supply. This may include your first name, last name, location, age, phone number, email address, postal address and other details that you have provided when interacting with us. We may also collect information on how you use our website, your product preferences, opinions and other personal preferences.

Other information that may be automatically collected when you visit our website include (without limitation) your Internet Service Provider (ISP), operating system, browser information, Internet Protocol (IP) address or other device identifiers, location and time/date stamp.

What we collect from you

User contact forms
When you fill out a contact form on our website, or digital media platforms we will collect that information and use it to get in touch with you in response to your query. We may use the information to reach out to you to inform you of some of the services we provide, provided it is in line with your original query.

Program or Online Course Participants
When you or your company enrolls in our programs or online courses, we collect the necessary information to provide you with access to course materials, updates, and any additional resources related to the program. This may include sending you important communications such as reminders, learning resources, and relevant updates about the program. You will also be added to our mailing list, meaning you have opted in and consented to receive emails related to our services and products. We may also use your information to inform you about other programs or services that align with your interests. Rest assured, we respect your privacy and comply with the guidelines set out by the Australian Communications and Media Authority.

Mailing List
If you sign up to one of our mailing lists, this means that you have opted-in and have consented to us sending you emails relating to the services or products we provide as a company. Don’t worry, we won’t spam you. We send all emails as per the guidelines set out by the Australian Communications and Media Authority.

What we collect from your online activity

  • Site performance indicators: these give us information on how our website is used, so that we can make the necessary improvements or amendments to make your experience better.
  • Analytics Cookies: these give us the statistics to understand how many people are on our website, which areas are popular and which areas we need to work on.
  • Advertising Cookies: we use these cookies to understand what type of advertising would be better suited to someone like you. That way, you would receive ads that are more likely to be relevant to you.

What we collect and receive from others

Third party polling and survey plugins (such as Survey Monkey)
When you fill out polls or surveys on our website using Survey Monkey or another third party survey provider, please bear in mind that while we retain control of the data that you provide, all data provided is collected under the privacy policy of that provider and therefore may vary from provider to provider. We do our best to select providers who adhere to Australian privacy laws.

Maps/Video and other embedded content
Embedded content such as Google Maps, YouTube videos etc. is embedded or placed on our website – it is not hosted on our servers and therefore any interaction with such services is done so in accordance with their privacy policy.

Advertising
We may use your personal information to deliver advertising that is more customised or relevant to your interests or location. This does not mean that you will receive more ads, it simply means that we will do our best to make them relevant and tailored to your interests. Cross-border Disclosure of Personal Information

Personal information may be stored with or disclosed to other entities overseas (who are not in Australia or an external Territory) who are directly affiliated with us in providing our service. As per APP 8, steps are taken to ensure that the overseas recipient does not breach the Australian Privacy Principles.

Direct Marketing

When it comes to direct marketing, no one likes being spammed. At Celeste Halliday Pty Ltd, we may use your personal information to send you advertising that is customised to your interests, characteristics or general location.

Opt-out
As with all direct marketing correspondence that you receive from us via email, there is always an unsubscribe button or link located at the bottom of the email. With this you can manage which messages you receive from us.

Use and Disclosure

We only use personal information for the purpose which was requested of us, or for the purposes which directly relate to one of our functions or activities. We will not provide your personal information to other entities or bodies, or any other party unless one of the following applies (as per and in line with APP 6 – use and disclosure of personal information):

  • You have consented.
  • You would reasonably expect, or have been informed, that information of such kind would be passed on to those individuals, entities or bodies (for more information, see subclause 6.2).
  • It is otherwise required or authorised by law, or reasonably necessary for the enforcement of a criminal law or of a law imposing a pecuniary penalty, or for the protection of public revenue.
  • It may prevent or lessen a serious and imminent threat to somebody’s life or health.

Data Security

We take active steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure, and against other misuse. Furthermore, all Celeste Halliday Pty Ltd employees or agents must abide by this policy. Access and Correction

At Celeste Halliday Pty Ltd, we do our best to keep your personal information up-to-date and accurate as this allows us to deliver a better service to you. Please bear in mind that under Australian privacy laws, there may be situations where we cannot provide access to such personal information. For instance, if it would reasonably affect someone else’s privacy or may pose a threat to someone’s life, health or safety.

In addition to our obligations under the Privacy Act, we also abide by the EU General Data Protection Regulation (GDPR) in the following ways:

  • You may request that we send to you, or give you access to all personal information we hold on you
  • You may exercise your right to be “forgotten”. This means that, upon request, we will erase all the personal information that we hold on you.
  • You may also fully withdraw consent to have any of your personal information collected.

Terms Of Service

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the https://www.celestehalliday.com website (the “Service”) operated by Celeste Halliday Pty Ltd  (“us”, “we”, or “our”).

The Service is not designed to provide qualitative advice regarding the fitness for purpose and merchantability of any products or services. We strongly advise you to exercise caution and do your own due diligence in conducting any transactions through the Service.

We are constantly updating our offerings of products and services on the Service. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

Means all forms of intellectual property rights throughout the world including but not limited to present and future:

(a)   patents, utility models, copyrights, registered or unregistered trademarks and service marks, trade names, brand names, indications of source or appellations of origin, eligible layout rights, registered designs and commercial names and designations;

(b)   all inventions, discoveries, trade secrets, secret process, know-how, computer products and confidential, scientific, technical and product information;

(c)   all other rights resulting from intellectual activity in the industrial, scientific, literary and artistic fields whether industrial or commercial;

(d)   all letters patent, deeds of grant, certificates or documents of title for anything referred to in paragraphs (a), (b) or (c) of this definition and all media in which any thing referred to in those paragraphs is stored or embodied; and

(e)   all enhancements to anything referred to in paragraphs (a) – (d),

of any kind whether arising from statute, under common law or in equity.

 

Learning Materials     

Means all forms of material including but not limited to presentations, documents, webinars and other materials whether in the public domain or not that were created by or for Celeste Halliday for the purpose of:

(a)   any of Celeste Halliday’s events, courses or coaching programs;

(b)   promoting Celeste Halliday or any of their events, courses or coaching program; or

(c)   any other activity of Celeste Halliday.

 Learning Materials may or may not also be Intellectual Property.

The Service, Learning Material, Intellectual Property and the Service’s original content (excluding Content provided by users), features and functionality are and will remain our exclusive property.

The Service, Learning Material and Intellectual Property are protected by copyright, trademark, and other laws of both Australia and other countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Nothing in these Terms constitutes a transfer of any Intellectual Property rights from us to you.

You are permitted to use the Service only as authorised by us. As a user, you are granted a limited, non-exclusive, revocable, non-transferable right to use the Service to create, display, use, play, and download Content subject to these Terms.

 Our Intellectual Property must not be used in connection with a product or service that is not affiliated with us or in any way brings us into disrepute.

 You must not modify the physical or digital copies of any Content you print off or download in any way, and you must not use any illustrations, photographs, video or audio, or any graphics separately from any accompanying text.

Any opinions, advice, statements, services, offers, or other information or content expressed or made available by any other users are those of the respective authors or distributors and not of us.

You acknowledge that you do not have and nothing in the Terms or in connection with the Service or any other agreement or document between you and Celeste Halliday gives you any right, title or interest in or to any of Learning Material or Intellectual Property.

 You agree:

  • Not to use our Learning Material or Intellectual Property for any purpose other than your private business purposes, in particular, you will not use the Learning Material or Intellectual Property to in any way replicate the Service or create comparable or competitive services to Celeste Halliday; and
  • Not do or cause to be done anything which may in any way jeopardise or adversely affect Celeste Halliday’s ownership, use or any rights it may have in the Learning Material or Intellectual Property.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions were taken by us in connection therewith.

If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Service or by sending a communication to any address (email or otherwise) that we have for you in our records.

Indemnification

As a condition of your access to and use of the Service, you agree to indemnify us and our successors and assigns for all damages, costs, expenses and other liabilities, including but not limited to legal fees and expenses, relating to any claim arising out of or related to your access to and use of the Service or your breach of these Terms and any applicable law or the rights of another person or party.

Limitation Of Liability

We do not endorse any products and services, and expressly disclaim any and all liability in connection with them. In no event shall we be liable for any claims by a third party in tort or contract, or pursuant to the Competition and Consumer Act 2010 (Cth) including, but not limited, to any misleading statements made and/or incorporated into any Content provided by third parties, such as manufacturers and wholesalers, and users of the Service. It is your sole responsibility to ensure the accuracy of the data inputted.

You have sole responsibility for adequate security protection and backup of data and/or equipment used in connection with your usage of the Service and will not make a claim against us for lost data, re-run time, inaccurate instruction, work delays or lost profits resulting from the use of the Service. You must not assign or otherwise dispose of your account to any other person.

Without limiting the foregoing, in no event will our aggregate liability to you exceed, in total, the amounts paid by you to us.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

It is your sole responsibility to periodically check these Terms for any changes. If you do not agree with any of the changes to these Terms, it is your sole responsibility to stop using the Service. Your continued use of the Service will be deemed as your acceptance thereof.
